Terms of Service (EULA)

This Terms of Service document ("Terms") constitutes a legally binding agreement between you ("User," "you," or "your") and MIRACLE IT INC LIMITED ("Fiture," "we," "us," or "our") governing your use of the Fiture - fitness of the future mobile application (the "Application") and any related services.

By installing, accessing, or using the Application, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you must not install or use the Application.

End-User License Agreement (EULA)

Acknowledgment

You and Fiture acknowledge that these Terms are concluded between you and Fiture only, and not with Apple Inc. ("Apple"). Fiture, not Apple, is solely responsible for the Application and its content.

Scope of License

Fiture grants you a limited, non-exclusive, non-transferable, revocable license to use the Application for your personal, non-commercial use on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.

Maintenance and Support

Fiture is solely responsible for providing any maintenance and support services for the Application. You and Fiture acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Application.

Warranty

Fiture is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Application to you (if any). To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Application.

Product Claims

You and Fiture acknowledge that Fiture, not Apple, is responsible for addressing any claims by you or any third party relating to the Application or your possession and/or use of the Application, including, but not limited to:
(i) product liability claims;
(ii) any claim that the Application fails to conform to any applicable legal or regulatory requirement;
(iii) claims arising under consumer protection, privacy, or similar legislation.

Intellectual Property Rights

You and Fiture acknowledge that, in the event of any third-party claim that the Application or your possession and use of the Application infringes that third party’s intellectual property rights, Fiture, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

Legal Compliance

You represent and warrant that:
(i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country;
(ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

Third-Party Beneficiary

You and Fiture acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

Medical Disclaimer and Health Information Declaration

Not a Medical Device

Fiture is a fitness and wellness application designed for general health and fitness purposes. The Application is NOT a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition.

Consult Healthcare Professionals

Always consult with a qualified healthcare provider before starting any new exercise program or making changes to your diet. This is especially important if you have pre-existing medical conditions. The Application does not replace professional medical advice, diagnosis, or treatment.

Exercise Safety

You are responsible for exercising safely. Stop exercising immediately and consult a professional if you experience chest pain, dizziness, severe shortness of breath, nausea, or any unusual pain or discomfort.

Age Restrictions

The Application is intended for users 13 years and older. Users under 18 should have parental or guardian supervision when using exercise features.

Accuracy Disclaimer

Data provided by the Application, including fitness tracking, calorie estimates, and other metrics, are estimations and may not be 100% accurate. AI-generated workout recommendations are for guidance only and may not be suitable for all users. Do not rely solely on Application data for health decisions.

User Responsibilities

By using this Application, you acknowledge and agree that you use it at your own risk, will consult healthcare providers as appropriate, will listen to your body and exercise safely, and understand the Application's limitations.

Emergency Situations

The Application does not provide emergency services. In case of a medical emergency, contact your local emergency services immediately.

User Accounts and Subscriptions

Account Creation

To use certain features, you may be required to create an account. You agree to provide accurate and complete information and to keep this information up to date.

Subscriptions

The Application may offer auto-renewing subscriptions. Payment will be charged to your App Store account. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. You can manage your subscriptions and turn off auto-renewal in your Account Settings after purchase.

Prohibited Conduct

Use the Application for any illegal purpose.
Reverse engineer, decompile, or attempt to extract the source code of the Application.
Infringe upon the intellectual property rights of Fiture or any third party.
Distribute viruses or any other malicious code.

Termination

We may terminate or suspend your access to the Application at any time, without prior notice or liability, for any reason, including if you breach these Terms.

Governing Law

These Terms shall be governed by the laws of the jurisdiction in which Fiture is based, without regard to its conflict of law provisions.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes. Your continued use of the Application after such changes constitutes your acceptance of the new Terms.
